DHS Proposes Elimination of Duration of Stay

On September 25, 2020, the Department of Homeland Security proposed a new rule in the Federal Register to eliminate the Duration of Status class of admission for F-1 Students.  Under the proposed rule, individuals applying for admission in F status would be admitted for the length of time indicated by their program end date, not to exceed 4 years, instead of being admitted for “duration of status”  This does not mean that this is final law. This proposed rule will go through a period of public comment ending on October 26,2020. It is important to note that this will not immediately have consequences for our students. Students will continue to be able to make normal progress in their program of study and will be eligible to remain in status for the time listed on the I-20 document. ISAP will continue to monitor this proposed rule and keep our students and community informed of any updates along the way.
